Abstract

Limitation on sentence upon revocation of suspensionof sentence; technical violations. Provides that a court mayimpose a sentence of a term of active incarceration upon a firstor second technical violation of the terms and conditions of a suspendedsentence or probation, and may impose a term of not more than 14days of active incarceration for a first technical violation anda term of not more than 30 days of active incarceration for a secondtechnical violation. Under current law, a court shall not impose aterm of any active incarceration upon a first technical violationand may impose a term of not more than 14 days of active incarcerationfor a second technical violation.
