Neurobehavioral and neurorehabilitation facilities; waiver services for individuals w/brain injury.

Abstract

Department of Medical Assistance Services; establishmentof neurobehavioral and neurorehabilitation facilities; waiver servicesfor individuals with traumatic brain injuries and neurocognitivedisorders; work group. Directs the Department of Medical AssistanceServices to amend the state plan for medical assistance servicesto add neurobehavioral and neurorehabilitation facilities to supportindividuals with traumatic brain injuries and neurocognitive disordersby January 1, 2025. The bill also directs the Department to submitan amendment to the state plan for medical assistance services tothe Centers for Medicare and Medicaid Services to modify its existing1915(c) waiver or seek a new 1915(c) waiver as necessary to receivefederal approval to administer home and community-based services forqualifying individuals with traumatic brain injuries or neurocognitivedisorders as defined by the Department no later than January 1, 2026.The bill gives the Department authority to promulgate emergency regulationsfor the neurobehavioral and neurorehabilitation facilities and thetraumatic brain injury waiver upon approval. The bill requires theDepartment to convene a work group of relevant stakeholders to provideupdates on the progress and the implementation of the neurobehavioraland neurorehabilitation facilities and the traumatic brain injuryservices waiver.
