Local and Regional Jails, State Board of; powers and duties.

Abstract

State Board of Local and Regional Jails; powers and duties. Requires the State Board of Local and Regional Jails, when promulgating regulations and adopting any policy or guidance document related to the enforcement of any minimum standards applicable to local, regional, or community correctional facilities, to expressly and specifically include such items in its published agenda for meetings of the Board or any of its subcommittees. The bill also requires the Board, when developing and implementing policies and procedures for the review of the death of any inmate or when establishing minimum standards for health care services, to adhere to procedures of the Administrative Process Act.

Requires the State Board of Local and Regional Jailswhen promulgating regulations and adopting any policy or guidancedocument related to the enforcement of any minimum standards applicableto local, regional, and community correctional facilities, to expresslyand specifically include such items in its published agenda for meetingsof the Board or any of its subcommittees.. The bill also providesthat the Board when developing and implementing policies and proceduresfor the review of the death of any inmate or when establishing minimumstandards for health care services, including medical, dental, pharmaceutical,and behavioral health services, in local, regional, and communitycorrectional facilities and procedures for enforcing such minimumstandards, the Board shall adhere to procedures of the AdministrativeProcess Act. The bill also provides that the Board in enforcing anyadopted health care services standards, the Board shall not find thefacility or its non-health care staff in violation of any such standardsdue to the actions or inactions of licensed medical or mental healthprofessionals, as long as the facility has met the applicable standardsto have such care available and relied on the opinion of such licensedprofessionals in the provision of care.

Requires the State Board of Local and Regional Jailsto follow the procedures of the Administrative Process Act when promulgatingminimum standards and adopting any policy or procedure related tothe enforcement of any minimum standards applicable to local, regional,and community correctional facilities. The bill also provides thatthe Board in enforcing any adopted health care or behavioral healthcare standards shall not find the facility or its non-health carestaff in violation of any such standards due to the actions or inactions of licensed medical or mental health professionals as long as thelocal, regional, or community correctional facility has met the applicablestandards to have such care available.
