Workers' compensation; failure to market residual capacity.

Abstract

Workers' compensation; failure to market residualcapacity. Provides that an employee is not barred from receivingworkers' compensation benefits due to a failure to market residualwork capacity if credible evidence supports that the employee (i)is reasonably unemployable based upon age, education, work history,or medical conditions or (ii) is employable in some capacity andhas registered with the Virginia Employment Commission.
