Unrestorably incompetent defendant; competency report.

Abstract

Unrestorably incompetent defendant; competencyreport. Provides that in cases where a defendant was previouslydetermined to be unrestorably incompetent in the past two years,a competency report may recommend that the court find the defendantunrestorably incompetent to stand trial, and the court may proceedwith the disposition of the case based on such recommendation. Undercurrent law, the defendant is required to undergo treatment to restorehis competency before the court can find a defendant unrestorablyincompetent to stand trial.
