Aggravated sexual battery; penalty.

Abstract

Aggravated sexual battery; penalty. Provides that any massage therapist, person practicing the healing arts, or physical therapist, or a person purporting to be such practitioner, who sexually abuses another person without the express consent of the complaining witness is guilty of aggravated sexual battery.

Aggravated sexual battery by false representationor subterfuge; penalty. Provides that any person who sexuallyabuses another person through false representation or subterfuge that is part of a massage by a massage therapist, a medical procedure,or physical therapy is guilty of aggravated sexual battery if suchabuse is intentional and without the consent of the complaining witness.The bill also eliminates the provision that sexual battery can beaccomplished by ruse.
