Construction management contracts; use by local public bodies. Removes the provision limiting the use of construction management contracts by local public bodies to projects with a cost expected to exceed $10 million and provides that construction management may be utilized on projects where the project cost is expected to be less than the project threshold established in the procedures adopted by the Secretary of Administration for using construction management contracts. This bill is identical to HB 890.
Construction management or design-build contracts; use by local public bodies. Limits the use of construction management by localities to projects where the project cost is expected to be less than the project cost threshold established in the procedures adopted by the Secretary of Administration for utilizing construction management or design-build contracts, provided that (i) the project is a complex project and (ii) the project procurement method is approved by the local governing body. Current law allows unqualified construction management for projects over $10 million and construction management meeting the provisions in (i) and (ii) for projects under $10 million.
Construction management and design-build contracting;use by state and local public bodies. Authorizes all state andlocal public bodies to use construction management contracts forprojects with a cost expected to exceed $26 million. For projectswhere the cost is not expected to exceed $26 million, state and localpublic bodies must make written determination that competitive sealedbidding is not practicable or fiscally advantageous, document thebasis for the determination to use construction management or design-build,and follow statutorily mandated procedures. The bill also amendsthe definition of "complex project."
