Professional and Occupational Regulation, Department of; cemeteries, exemptions.

Abstract

Department of Professional and Occupational Regulation; cemeteries; exemptions. Defines "church," for the purpose of determining whether a cemetery that is owned and operated by a church is exempt from regulation by the Department of Professional and Occupational Regulation, to include a church that operates as a historic landmark. This bill is identical to SB 519.

Department of Professional and OccupationalRegulation; cemeteries; exemptions. Clarifies that a cemetery wholly owned and operated by a nonstock corporation not operatedfor profit is exempt from regulation by the Department of Professionaland Occupational Regulation if, among other things, such corporationuses the proceeds from the sale of all graves and entombment rightsfor the purpose, but not necessarily the sole purpose, of defrayingthe direct expenses of maintaining the cemetery. Current law requiresthat proceeds from the sale of graves and entombment rights be usedfor the sole purpose of defraying the direct expenses of maintainingthe cemetery.
