Abstract

A BILL TO AMEND ARTICLE 4, CHAPTER 1, TITLE 25 OF THE 1976 CODE, RELATING TO THE SOUTH CAROLINA EMERGENCY MANAGEMENT DIVISION, BY ADDING SECTION 25-1-435, TO CREATE, POPULATE, AND PROVIDE TERMS FOR THE BOARD OF EMERGENCY MANAGEMENT; AND TO AMEND SECTION 25-1-440(a)(2), RELATING TO THE ADDITIONAL POWERS AND DUTIES OF THE GOVERNOR DURING A STATE OF EMERGENCY, TO PROVIDE THAT A STATE OF EMERGENCY CANNOT BE EXTENDED BEYOND FIFTEEN DAYS WITHOUT THE AUTHORIZATION OF THE BOARD OF EMERGENCY MANAGEMENT, TO PROVIDE THAT THE BOARD SHALL BE VESTED WITH THE SAME POWERS THAT WERE VESTED IN THE GOVERNOR DURING THE INITIAL FIFTEEN DAY EMERGENCY DECLARATION, AND TO PROVIDE FOR A PROCEDURE TO ALTER THE PROVISIONS OF AN EMERGENCY DECLARATION.
