Relating to theft.

Abstract

Creates a new way of committing the crime of theft in the second degree when the theft occurs from a dwelling or within the curtilage of a residence. Punishes by a maximum of 364 days' imprisonment, $6,250 fine, or both. Creates two new ways of committing the crime of theft in the first degree when the theft occurs from a dwelling or within the curtilage of a residence. Punishes by a maximum of five years' imprisonment, $125,000 fine, or both. Directs the Oregon Criminal Justice Commission to rank theft in the first degree at specified crime category levels. Creates a new way of committing the crime of aggravated theft in the first degree when the theft occurs from a dwelling or within the curtilage of a residence. Punishes by a maximum of 10 years' imprisonment, $250,000 fine, or both. Modifies and creates two new ways of committing the crime of organized retail theft. Increases the penalties for organized retail theft if the person possesses a firearm during the commission of the offense or has two or more prior convictions. Punishes by a maximum of 20 years' imprisonment, $375,000 fine, or both. Directs the Oregon Criminal Justice Commission to rank organized retail theft at specified crime category levels.
