Relating to required conduct among parties to a franchise agreement.

Abstract

Requires parties to franchise agreement to deal in good faith and commercially reasonable manner, and specifies required disclosures in franchise sale transaction. Specifies requirements for franchise agreement. Prohibits certain practices in terminating or refusing to renew franchise agreement. Requires franchisor to purchase covered property from franchisee with which franchisor terminates or refuses to renew franchise agreement, and specifies exemptions from requirement. Requires franchisor to permit franchisee to sell, assign or transfer to another person franchise, all or substantially all assets of business that operates under franchise agreement with franchisor, or controlling interest or other interest in franchise under specified circumstances. Prohibits certain other conduct of franchisor. Permits franchisee to bring action for damages and equitable relief for franchisor's violation of provisions of Act.
