Unlawful Use/Poss Flamethrower

Abstract

Amends the Criminal Code of 2012. Creates the offense of unlawful possession of a flame-thrower. Provides that a person commits the offense when he or she knowingly possesses or carries a flame-thrower. Creates the offense of unlawful use of flame-thrower. Provides that a person commits the offense when he or she knowingly discharges a burning stream of combustible or flammable liquid from a flame-thrower. Provides that a person who either unlawfully possesses or uses a flame-thrower is guilty of a Class 4 felony. Defines flame-thrower a non-stationary and transportable device that is designed or intended to emit or propel a burning stream of combustible or flammable liquid a distance of at least 10 feet. Effective immediately.
