Vehicle Code-Relocate Charge

Abstract

Amends provisions of the Illinois Vehicle Code requiring the Illinois Commerce Commission to set reasonable rates for the commercial towing or removal of trespassing vehicles from private property. Deletes language providing that no relocator shall impose charges for storage for the first 24 hours after towing or removal. Deletes language providing that rates for other services provided by relocators shall not be charged to the owner or operator of a relocated vehicle. Deletes language providing that a fee charged by a relocator for the use of a credit card to pay for any service rendered by the relocator shall be included in the total amount that shall not exceed the maximum reasonable rate established by the Commission and that the Commission shall require a relocator to refund any such fee. Deletes language providing that it shall be unlawful for any commercial vehicle relocator to fail to refund any amount charged in excess of the reasonable rate established by the Commission.
