Civpro-Emnent Domain-Publc Use

Abstract

Amends the Code of Civil Procedure. Provides that the State, a political subdivision of the State, or a municipality may exercise its eminent domain powers to take or damage private property only for a public use. Provides that the State, a political subdivision of the State, or a municipality may not take or damage private property for the purpose of transferring the property to a private for-profit entity. Limits the concurrent exercise of home rule powers. Effective immediately.
