Crim Cd-Firearm Tracing

Abstract

Amends the Criminal Code of 1961. Provides that a law enforcement agency that requests a firearms trace, within a reasonable time, but no later than 60 days after the termination of the investigation for which the trace was initiated or records were requested or immediately upon the initiation of criminal proceedings, shall serve the person who was the subject of a records request or search with an inventory containing certain information. Permits the circuit court of the county of the person's residence, upon a motion filed by the person who is the subject of a records request or search, to order the destruction of all records associated with the trace request, except those required to be kept under the federal Gun Control Act of 1968, the Criminal Code of 1961, the Firearm Owners Identification Card Act, or those records pertaining to an open and active criminal investigation or proceeding. Effective immediately.
