Firearm Crimes-Penalties

Abstract

Amends the Criminal Code of 1961 and the Unified Code of Corrections. Provides that the commission of armed violence with a Category I weapon is a Class X felony for which the defendant shall be sentenced to a minimum term of imprisonment of 20 rather than 15 years. Provides that the commission of armed violence with a Category II weapon is a Class X felony for which the defendant shall be sentenced to a minimum term of imprisonment of 15 rather than 10 years. Eliminates the provisions added by Public Act 91-404 for the enhancement of penalties for the commission of various offenses with a firearm that have been held unconstitutional on the basis of disproportionate sentencing by the Illinois Supreme Court in People v. Moss.
