Lead Poisoning Prevention

Abstract

Creates the Lead Poisoning Prevention Act of 2003 and amends various Acts. Establishes a Lead Poisoning Prevention Coordinating Council and a Lead Poisoning Prevention Commission. Defines the criteria for lead-free and lead safe property status. Provides for the inspection of properties affected by lead poisoning, as well as for the accreditation of inspectors and contractors. Provides for the registration of affected properties. Establishes immunity from civil liability to a person at risk for an affected property owner who complies with the lead-free or lead-safe standards and offers to pay medical expenses, relocation costs, and attorney's fees. Requires insurers to extend liability coverage to rental property owners for losses or damages caused by exposure to lead-based paint. Provides for a tax credit to persons or entities hiring accredited contractors to perform the required removal of lead-based paint hazards or other statutorily required repairs. Establishes a Lead-Removal Inspectors Accreditation Fund to hold fees for the registration of persons performing lead hazard abatement or inspections. Establishes a Lead Poisoning-Affected Properties Registration Fund to hold fees for the registration of affected properties. Establishes a Lead-Safe and Lead-Free Property Revolving Loan Fund for a revolving loan program to bring affected areas into compliance. Provides for criminal and civil enforcement of the Act. Creates a private right to injunctive relief. Prohibits retaliatory evictions. Provides for the creation of educational programs designed to inform the public of the problem of lead poisoning and its prevention. Requires the Director of Public Health to establish a program for early identification of persons at risk. Repeals the Lead Poisoning Prevention Act. Effective immediately.
