Nurs Hm-Privacy Of Records

Abstract

Amends the Nursing Home Care Act. Provides that a resident and relatives of a resident have the right to keep their medical records private. Provides that if a facility closes, the owner of the facility may be held liable if a resident's medical records are not correctly transferred to (i) another facility, (ii) the resident, or (iii) the resident's relative or guardian. Provides that a facility that has violated or compromised the privacy of a resident's medical record shall be subject to the same penalties as those imposed under the federal Health Insurance Portability and Accountability Act. Effective immediately.
