Frivolous Law Suit-Sanctions

Abstract

Amends the Code of Civil Procedure. Provides for a sanction on the responsible party, his or her attorney, or both if the court finds that an action is frivolous, in bad faith, or for an improper purpose. The sanction is that the court, in its discretion, may order the payment to the State, county, or both of amounts reasonably calculated to reimburse the State, the county, or both for the costs of processing the action and providing personnel and facilities in connection with the action.
