Civ Pro-Med Malpractice-Sanctn

Abstract

Amends the Civil Practice Law of the Code of Civil Procedure. In provisions concerning pleading in healing art malpractice cases, allows the court to impose sanctions against a party or attorney if it determines that (i) there has been a willful failure to comply with those provisions or (ii) the action is frivolous or otherwise not commenced in good faith. Provides that appropriate sanctions include a bar against presenting a claim or defense and an order to pay damages and costs. Effective immediately.
