Aids-Confidential-Tests

Abstract

Amends the AIDS Confidentiality Act. Provides that no health care provider (rather than no physician) may order an HIV test without making specified information available to the person tested. Provides that testing shall be conducted in accordance with the guidelines of the Centers for Disease Control and Prevention. In provisions allowing a physician to notify the spouse of the test subject if the test result is positive and has been confirmed, deletes a requirement that the confirmation must be by a Western Blot Assay or more reliable test. In provisions providing that a health care provider who ordered the test of a minor under 18 years of age shall make a reasonable effort to notify the minor's parent or legal guardian under specified circumstances if the minor's test result is positive and has been confirmed, deletes a requirement that the confirmation must be by a Western Blot Assay or more reliable test.
