Amends the Illinois Freedom to Work Act. Provides any covenant not to compete or covenant not to solicit entered into after the effective date of the amendatory Act shall not be enforceable with respect to professionals licensed in this State who provide mental health services to veterans and first responders. Effective immediately. Senate Floor Amendment No. 1 Replaces everything after the enacting clause. Amends the Illinois Freedom to Work Act. Provides that any covenant not to compete or covenant not to solicit entered into after the effective date of the amendatory Act shall not be enforceable with respect to the provision of mental health services to veterans and first responders by any licensed mental health professional in the State if the enforcement of the covenant not to compete or covenant not to solicit would result in an undue burden on veterans or first responders seeking mental health services. Defines terms. Effective immediately. House Floor Amendment No. 1 Replaces everything after the enacting clause. Reinserts the provisions of the engrossed bill with the following changes. Provides that the enforcement of a covenant not to compete or covenant not to solicit described in the amendatory Act shall not be enforceable if it is likely to result in an increase in cost or difficulty for any veteran or first responder seeking mental health services (rather than would result in an undue burden on veterans or first responders seeking mental health services). Defines "licensed mental health professional" as a person licensed under the Clinical Psychologist Licensing Act, the Clinical Social Work and Social Work Practice Act, the Marriage and Family Therapy Licensing Act, the Nurse Practice Act, or the Professional Counselor and Clinical Professional Counselor Licensing and Practice Act (rather than a person who is licensed or registered to provide mental health services by the Department of Financial and Professional Regulation or a board of registration duly authorized to register or grant licenses to persons engaged in the practice of providing mental health services in Illinois). Changes the effective date to January 1, 2025.
