County School Facility Revenue

Abstract

Amends the County School Facility and Resources Occupation Tax Law of the Counties Code. Provides that, for elections held after the effective date of the amendatory Act, regional superintendents of schools must, upon receipt of a resolution or resolutions of school district boards that represent more than 51% of the student enrollment within the county or two-thirds of the school districts (currently, upon receipt of a resolution or resolutions of school district boards that represent more than 50% of the student enrollment within the county), certify the question regarding imposition of the school facility and resources occupation tax to the proper election authority for submission to the electors of the county at the next regular election at which the question lawfully may be submitted to the electors. Effective immediately. House Committee Amendment No. 1 Deletes reference to: 55 ILCS 5/5-1006.7 Adds reference to: 55 ILCS 5/1-1001 from Ch. 34, par. 1-1001 Replaces everything after the enacting clause. Amends the Counties Code. Makes a technical change in a Section concerning the short title. House Floor Amendment No. 2 Deletes reference to: 55 ILCS 5/1-1001 Adds reference to: 105 ILCS 5/34-3 from Ch. 122, par. 34-3 105 ILCS 5/34-4 from Ch. 122, par. 34-4 Replaces everything after the enacting clause. Provides that, if and only if Senate Bill 689 of the 103rd General Assembly becomes law in the form it passed the House on November 8, 2023, then the School Code is amended. Specifies that the provisions of certain provision of the Code concerning conflicts of interest of school board members apply to members of the Chicago Board of Education when members of the Board are considering any contract, work, or business of the district. Specifies that the provisions of the Public Officer Prohibited Activities Act that apply to persons holding elected or appointed public office also apply to members of the Chicago Board of Education. Makes conforming changes in a provision concerning the eligibility of individuals to serve on the Chicago Board of Education. Effective June 1, 2024.
