Gaming-Occup License Standard

Abstract

Amends the Illinois Gambling Act. Provides that specified provisions concerning the eligibility for an occupational license and convictions of certain offenses shall not apply to individuals performing certain services. Provides that the Illinois Gaming Board shall instead apply the criteria and process of provisions concerning conviction records of the Illinois Human Rights Act to individuals performing the specified services in the same manner as if it were the prospective employer of such individuals. Senate Floor Amendment No. 1 Adds reference to: 5 ILCS 100/5-45.35 new Replaces everything after the enacting clause. Amends the Illinois Gambling Act. Provides that to be eligible for an occupational license, an applicant must not have been convicted of a felony offense, a violation of specified laws, or a similar statute of any other jurisdiction if the applicant will perform any function involved in gaming by patrons (rather than must not have been convicted of a specified offense); and an applicant must not have been convicted of a crime involving dishonesty or moral turpitude if the applicant will perform any function involved in gaming by patrons (rather than must not have been convicted of a crime involving dishonesty or moral turpitude). Provides that the Illinois Gaming Board may in its discretion refuse an occupational license to any person who has a background that poses a threat to the public interests of the State or to the security and integrity of gaming. Sets forth provisions that the Board shall consider when considering criminal convictions of an applicant. Amends the Illinois Administrative Procedure Act. Provides for emergency rulemaking.
