Abstract

Amends the Firearm Owners Identification Card Act. Lowers the age at which a person who is not an active duty member of the United States Armed Forces may apply for a Firearm Owner's Identification Card from 21 to 18 and provides that a person who is under 18 years of age may apply for a Firearm Owner's Identification Card without parental consent required if he or she is an active duty member of the United States Armed Forces. Provides that if the applicant is under 18 (rather than under 21) years of age that he or she has never been convicted of a misdemeanor other than a traffic offense or adjudged delinquent and is an active duty member of the United States Armed Forces. House Floor Amendment No. 1 Deletes reference to: 735 ILCS 35/1 Adds reference to: 740 ILCS 180/1 from Ch. 70, par. 1 740 ILCS 180/2 from Ch. 70, par. 2 Replaces everything after the enacting clause. Amends the Wrongful Death Act. Provides that an action under the Act may be filed to recover punitive damages. Provides that punitive damages are not available in actions against the State or an employee of the State in his or her official capacity. Makes conforming changes. Amends the Probate Act of 1975. Provides that actions for punitive damages for an injury to the person survive. Provides that punitive damages are not available in actions against the State or an employee of the State in his or her official capacity. Effective immediately. House Floor Amendment No. 3 Provides that punitive damages are not available in an action against a unit of local government or an employee of a unit of local government in his or her official capacity. Provides that punitive damages are not available in an action for healing art malpractice or legal malpractice.
