Amends the Health Care Worker Background Check Act. Provides that a health care employer may hire any individual in a position involving direct care for clients, patients, or residents, or access to the living quarters or the financial, medical, or personal records of clients, patients, or residents who has been convicted of committing or attempting to commit specified offenses under the laws of the State, the laws of any other state, or the laws of the United States of an offense that is substantially equivalent to those offenses listed. Provides the names of various offenses that do not bar an individual from being hired by a health care employer. Provides that the Illinois State Police shall: forward an applicant's fingerprints to the Federal Bureau of Investigation; and request the Federal Bureau of Investigation to conduct a national criminal history pertaining to the applicant. Makes corresponding changes. House Floor Amendment No. 1 Replaces everything after the enacting clause. Amends the Health Care Worker Background Check Act. In provisions concerning a health care employer or long-term care facility hiring individuals convicted of committing or attempting to commit various specified offenses, adds substantially equivalent offenses under the laws of any other state or of the laws of the United States, as verified by court records, records from a state agency, or an Federal Bureau of Investigation criminal history records check. In provisions concerning fingerprint-based criminal history records, provides that fingerprints submitted shall be transmitted through a live scan fingerprint vendor licensed by the Department of Financial and Professional Regulation. Provides that fingerprints shall be checked against the Illinois State Police and Federal Bureau of Investigation criminal history records databases now and hereafter filed, including, but not limited to, civil, criminal, and latent fingerprint databases (instead of fingerprints submitted shall be checked against the fingerprint records now and hereafter filed in the Illinois State Police criminal history record databases). Provides that fee charged for conducting the criminal history records check shall be deposited into the State Police Services Fund. Provides that the Illinois State Police shall furnish, pursuant to positive identification, records of Illinois convictions and shall forward the national criminal history record information to the department or agency. Provides that the Illinois State Police shall forward the applicant's fingerprints to the Federal Bureau of Investigation. Provides that the Illinois State Police shall request that the Federal Bureau of Investigation conduct a national criminal history pertaining to the applicant.
