Mandamus-Sua Sponte Dismissal

Abstract

Amends the Code of Civil Procedure. Provides that if the court determines that a petition for mandamus is frivolous or patently without merit, it shall dismiss the petition on its own motion. Provides that the order of dismissal is a final judgment and shall be served upon the petitioner by certified mail within 10 days of its entry. Racial Impact Note (Admin Office of the Illinois Courts) After reviewing the legislation, the Administrative Office of the Illinois Courts is unable to determine what impact, if any, the bill might have on racial and ethnic minorities. Judicial Note (Admin Office of the Illinois Courts) The legislation will not increase or decrease the number of judges needed in the State of Illinois.
