Crim Pro-Incarceration Credit

Abstract

Amends the Code of Criminal Procedure of 1963. Provides that any person incarcerated on a bailable offense who does not supply bail and against whom a fine is levied on conviction of the offense shall be allowed a credit of $30 (rather than $5) for each day so incarcerated upon application of the defendant. House Floor Amendment No. 1 Adds reference to: 705 ILCS 135/5-20 Amends the Criminal and Traffic Assessment Act. Provides that any credit for time served prior to sentencing that reduces the amount a defendant is required to pay shall be deducted from the fine, if any, ordered by the court (rather than any credit for time served prior to sentencing that reduces the amount a defendant is required to pay shall be deducted first from the fine, if any, ordered by the court). Deletes that any remainder of the credit shall be equally divided between the assessments indicated in the ordered schedule and conditional assessments.
