Genetic Privacy-Insurance

Abstract

Amends the Genetic Information Privacy Act. Provides that long-term care and life insurance policies are among those for which an insurer may not seek information derived from genetic testing. Removes language specifying that a provision prohibiting an insurer from using or disclosing protected health information that is genetic information for underwriting purposes does not apply to insurers issuing long-term care policies. House Committee Amendment No. 1 Adds reference to: 410 ILCS 513/10 Replaces everything after the enacting clause. Amends the Genetic Information Privacy Act. Provides that "genetic testing" includes direct-to-consumer commercial genetic testing. Provides that a company providing direct-to-consumer commercial genetic testing is prohibited from sharing any genetic test information or other personally identifiable information about a consumer with any health or life insurance company without written consent from the consumer.
