Crim Pro-Motion To Vacate

Abstract

Amends the Code of Criminal Procedure of 1963. Permits a motion to vacate a conviction when the defendant's participation in the offense was a result of having been a trafficking victim (involuntary servitude, involuntary sexual servitude of a minor, or trafficking in persons) or a victim of a severe form of trafficking under the federal Trafficking Victims Protection Act (rather than for only a conviction of prostitution or felony prostitution under the Criminal Code of 1961 or the Criminal Code of 2012 or a similar local ordinance). Effective immediately.
