Sentencing and Imposition of Punishment; making determinations with respect to probation and suspension of sentences; provide

Abstract

A BILL to be entitled an Act to amend Article 1 of Chapter 10 of Title 17 of the O.C.G.A., relating to procedure for sentencing and imposition of punishment, so as to provide that in making determinations with respect to probation and suspension of sentences, the court shall inquire into and consider the legality of a prisoner's presence in the United States; to amend Article 2 of Chapter 9 of Title 42 of the O.C.G.A., relating to grants of pardons, paroles, and other relief, so as to provide that the State Board of Pardons and Paroles shall inquire into and consider the legality of a prisoner's presence in the United States when making parole decisions; to provide for related matters; to provide an effective date and to provide for a contingent effective date and for automatic repeal; to repeal conflicting laws; and for other purposes.
