Torts; a cap on damages recoverable against foster parents in personal injury actions involving the use of a motor vehicle by a child; provide

Abstract

A BILL to be entitled an Act to amend Title 51 of the Official Code of Georgia Annotated, relating to torts, so as to provide for a cap on damages recoverable against foster parents in personal injury actions involving the use of a motor vehicle by a child where the liability of the foster parent is based solely upon application of the family-purpose car doctrine or the negligent entrustment doctrine; to provide that such cap shall be the policy limits of the applicable motor vehicle liability insurance coverage, subject to conditions; to provide for definitions; to provide for related matters; to provide for applicability; to repeal conflicting laws; and for other purposes.
