Abstract

A BILL to be entitled an Act to amend Article 2 of Chapter 3 of Title 16 of the Official Code of Georgia Annotated, relating to justification and excuse, so as to provide for the creation of a rebuttable presumption that, in the defense of certain prosecutions, when the defendant has obtained a prior family violence protective or restraining order, such defendant possessed reasonable belief that force was necessary to protect himself or herself; to provide that certain evidence is not admissible in such cases; to provide for related matters; to provide for an effective date and applicability; to repeal conflicting laws; and for other purposes.
