Real Property and Land Use and Development

Abstract

Real Property and Land Use and Development; Requires counties & municipalities to authorize multifamily & mixed-use residential as allowable uses on parcels owned & authorized by specified entities & in PUDs; provides that certain affordable or workforce units qualify as affordable housing; prohibits counties & municipalities from restricting density, maximum lot size, floor area ratio, & height of proposed multifamily or mixed-use residential development below certain limits; revises ability of counties & municipalities to restrict height of multifamily or mixed-use residential developments that are adjacent to specified parcels; preempts certain ordinances or resolutions; preempts regulation of affordable housing to state; prohibits counties & municipalities from conditioning review or approval of applications for development permits or orders on waiver, forbearance, acquisition, transfer, or abandonment of development right; prohibits local governments from increasing accessory dwelling unit construction costs; requires local governments to submit reports to Department of Commerce & post reports online; authorizes board of county commissioners or governing body of municipality to exempt specified portions of property within multifamily projects & accessory dwelling units used to provide affordable housing; authorizes Florida Housing Finance Corporation to fund certain housing projects through public-private partnership agreement; prohibits discrimination in land use decisions & permitting based on development being affordable housing.
