Contraband Forfeiture

Abstract

Contraband Forfeiture; Requires stay of proceedings subsequent to probable cause finding for forfeiture; requires stay of forfeiture until final disposition of associated criminal charges or while prosecuting agency determines whether charges will be filed; requires written notice of such charges to court; requires conviction in associated criminal offense for forfeiture; requires return of seized property if all associated criminal charges are dismissed or prosecuting agency declines to file; prohibits agencies from transferring property seized under state law to federal agency for specified purpose.
