San Mateo County Flood and Sea Level Rise Resiliency District.

Abstract

Existing law, the San Mateo County Flood Control District Act, establishes the San Mateo County Flood Control District for the purpose of controlling the floodwater and stormwater of the County of San Mateo. The act makes the Board of Supervisors of the County of San Mateo the board of supervisors of the district, and assigns specified powers and duties to the district. This bill would rename the district the San Mateo County Flood and Sea Level Rise Resiliency District, and would add addressing and protecting against the impacts of sea level rise to the powers of the district. The bill would require, commencing January 1, 2020, the district to be governed by a board of directors, as provided, which would replace the Board of Supervisors of the County of San Mateo as the governing board of the district. The bill would require the provisions establishing the board of directors to remain in effect until resolutions approved by both the City/County Association of Governments of San Mateo County and the Board of Supervisors of the County of San Mateo provide that the district shall be governed by the Board of Supervisors of the County of San Mateo under the provisions in existing law. The bill would make various other changes to the act, including to financing provisions relating to taxes, assessments, and property-related fees and charges levied and collected by the district. By requiring local governments to appoint members to the San Mateo County Flood and Sea Level Rise Resiliency District in a specified manner, this bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.
