Private Attorneys General Act of 2004.

Abstract

Existing law, the Labor Code Private Attorneys General Act of 2004, authorizes an aggrieved employee who complies with certain notice and filing requirements, to bring a civil action to recover specified civil penalties that would otherwise be assessed and collected by the Labor and Workforce Development Agency, on behalf of the employee and other current or former employees for the violation of certain provisions affecting employees. Existing law provides that the court and the agency review and approve any penalties sought as part of a proposed settlement of a claim. Existing law until January 1, 2021, authorizes the agency to extend the time to complete its investigation by 60 days when the agency determines an extension is necessary and issues a notice, as specified. This bill would make nonsubstantive changes to these provisions.
