Deadly weapons: applications to the Department of Justice.

Abstract

Existing law generally regulates deadly weapons, including prohibitions on various types of deadly weapons. Under existing law, the Department of Justice is required to review and approve or deny applications for licenses and permits to, among other things, possess, sell, lease, transfer, manufacture, surrender, or dispose of certain other types of deadly weapons. This bill would require the department to make a determination on certain applications related to deadly weapons, and notify the applicant in writing of that determination, within 90 calendar days from the date the department receives the application. The bill would require the department to notify each applicant in writing within 30 calendar days from the date an application is received by the department if the department deems the application to be incomplete. The bill would also require a determination by the department denying an application to set forth the specific reasons for the department's denial of the application, and provide the applicant with a form for appealing the department's determination. The bill would define "determination" and "application" for those purposes.
