Motor vehicle replacement parts.

Abstract

Existing law regulates the use of motor vehicle replacement parts, and prohibits an insurer from requiring the use of nonoriginal equipment manufacturer aftermarket crash parts, as defined, in the repair of an insured's motor vehicle, unless the consumer is advised, in the written estimate and invoice, of the use of the part. A violation of those provisions is a crime. This bill would require that the use of nonoriginal equipment manufacturer certified aftermarket crash parts, including the name of the certifying entity, also be identified on the written estimate and invoice. Because this bill would expand the scope of a crime, it would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason.
