Elder abuse: theft or embezzlement: restitution.

Abstract

Existing law provides criminal penalties for any person who commits a crime involving theft, embezzlement, forgery, fraud, or identify theft, with respect to the property or personal information of the elder or dependent adult, as specified. This bill would authorize the prosecuting agency, as defined, in conjunction with a criminal proceeding alleging theft or embezzlement of property of an elder or dependant adult worth $100,000 or more, to file a petition, as prescribed, with the superior court of the county in which the defendant has been charged with the underlying criminal offense, for preservation of property of the defendant for purposes of restitution to the victim, as specified.
